The terms set forth herein (“Supplemental Terms”) are subject to the Pipedrive Terms of Service set forth at https://www.pipedrive.com/en/terms-of-service (the “Terms of Service”) and govern the use by Client of aspects of the Pipedrive Services that are powered by artificial intelligence, machine learning or similar technologies (collectively, “AI Functionality”). When AI Functionality is used by a Client, these Supplemental Terms form a legally binding contract between Client and Pipedrive. Unless set forth herein, defined terms are as set forth in the Terms of Service. In the event of a conflict between these Supplemental Terms and the Terms of Service, these Supplemental Terms shall govern.
The Supplemental Terms govern your use of the AI Functionality within the Pipedrive Services and, subject to your compliance with the Supplemental Terms and the Terms of Service, Pipedrive grants you a limited, non-exclusive, non-transferable, revocable license to use the AI Functionality solely for internal business purposes. The Supplemental Terms do not apply to the use of any Third-Party products or services that are not provided as part of the AI Functionality.
You may provide input to be processed by AI Functionality (“Input”), and receive output generated and returned by the AI Functionality based on the Input (“Output”). As between you and Pipedrive, Inputs and Outputs are your data or Client Data, as applicable. You will ensure that your Input and use of the AI Functionality or any Output will not violate any laws or agreements applicable to your use of the service, including obligations related to sharing of Client Data. You are solely responsible for the development, content, operation, maintenance and use of your data and Client Data, including any Input or Output. Due to the nature of artificial intelligence and machine learning, an Output may not be accurate or reliable and you should independently review all Output prior to using or sharing it. AI Functionality should be used as a tool, and Pipedrive does not provide a guarantee of accuracy when using AI Functionality.
Artificial intelligence and machine learning models can improve over time to better address specific use cases. We do not permit third parties to use Client Data to improve or train their AI models. We do not use Client Data to improve or train our models without your permission to do so.
You acknowledge that the AI Functionality and all related intellectual property rights are and shall remain the exclusive property of Pipedrive, including all algorithms or models and aggregated results of developing the AI Functionality.
You retain all rights to any Inputs and Outputs provided to or from the AI Functionality, and the Pipedrive will not claim ownership of such data. You may not use AI Functionality (i) to develop foundation models or other large scale models that compete with Pipedrive; (ii) to mislead any person that Output from the AI Functionality was solely human generated; or (iii) to use our services in a manner outside the scope of the Terms of Service or these Supplemental Terms. You acknowledge that due to the nature of machine learning and the technology powering the AI Functionality, Output may not be unique and our services may generate the same or similar output to Pipedrive or a third party.
You acknowledge that certain elements of the AI Functionality are powered by third-party AI service providers (“AI Service Providers”) and you agree that Pipedrive may share your Inputs and Outputs (including Client Data) with AI Service Providers, such as OpenAI, LLC (“OpenAI”), to facilitate the provision of AI Functionality. Data sharing by Pipedrive with third parties is governed by agreements and data processing terms between the Pipedrive and the AI Service Providers, designed to ensure the privacy and security of Client Data.
You may not use the AI Functionality in a manner that violates any terms, applicable laws, or any policy of any AI Service Provider. OpenAI Enterprise's policies can be accessed on the OpenAI Enterprise website.
You agree that Pipedrive shall not be liable for any acts, errors, omissions, or breaches committed by AI Service Providers in connection with the provision of AI Functionality or Pipedrive Services.
Due to the evolving nature of artificial intelligence tools, Pipedrive reserves the rights to modify the AI Functionality at any time without notice.
